Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the HearIQ Chrome extension ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by Digital Magnet Corporation ("Company," "we," "our," or "us"), a corporation registered in Ontario, Canada.

2. Description of Service

HearIQ is a text-to-speech Chrome extension that converts written text on web pages into spoken audio using artificial intelligence. The Service includes:

• Text-to-speech conversion of web page content
• Multiple AI-generated voice options
• Word-by-word text highlighting
• Playback controls and customization options

3. User Accounts and Registration

The basic version of HearIQ does not require account registration. Premium features may require you to create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Use the Service to convert content you do not have the right to access or reproduce
• Attempt to circumvent usage limits or technical restrictions
• Use the Service to generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated systems to access the Service in a manner that exceeds reasonable use
• Resell, redistribute, or commercially exploit the Service without authorization

5. Intellectual Property

The Service, including its design, features, and content, is owned by Digital Magnet Corporation and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

You retain ownership of any text content you submit for conversion. We do not claim ownership of your content.

6. Third-Party Services

HearIQ utilizes third-party text-to-speech providers to deliver AI voice synthesis. These providers have their own terms of service that may apply to the processing of your content. We are not responsible for the practices of third-party providers.

7. Service Availability

We strive to maintain reliable service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or server outages
• Third-party service disruptions
• Circumstances beyond our control

8. Fees and Payment

HearIQ offers both free and premium tiers. If you subscribe to a premium plan:

• Fees are billed in advance on a recurring basis
• You authorize us to charge your payment method
• Prices may change with reasonable notice
• Annual and monthly Premium purchases include a 30-day money-back guarantee
• Refund requests outside the 30-day window are handled on a case-by-case basis

9. Fair Usage Policy

HearIQ plans are designed for normal, personal listening. The free tier includes a daily listening allowance that resets each day. Premium includes a generous listening volume intended to comfortably cover an individual's reading and listening, subject to this fair usage policy.

To keep the Service fast and affordable for everyone, we may apply temporary limits, throttle synthesis, or require a plan change where usage patterns materially exceed typical individual use, including:

• Automated, scripted, or bulk text-to-speech conversion
• Sharing one account or license across multiple people or devices acting as different users
• Using the Service to build, feed, or redistribute another product or dataset
• Sustained volumes far beyond what an individual could reasonably listen to

Where practical, we will notify you and suggest an appropriate plan before applying limits. Allowances and limits may be adjusted over time with reasonable notice, as described in Section 14.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

We do not guarantee the accuracy, quality, or appropriateness of AI-generated speech output. Voice synthesis results may vary.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL MAGNET CORPORATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Digital Magnet Corporation from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may stop using the Service at any time by uninstalling the extension.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated through the Service or our website. Continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.
